Understanding Fee Disputes If you have a fee dispute when your present attorney, you should be proactive about disputing the bill. Make sure you fax or email your specific concerns about the bill as soon as you recieve it. If you are not satisfied with your lawyer's response, you may need to file a Fee Arbitration Dispute with the San Diego County Bar Association.
Charges that can be removed from your billing statements: --You were billed for services not performed or billed for more time than the services should have taken the attorney or staff to perform. --You were billed for administrative services, (such as keeping your file updated.) --You were billed for services you specifically did not authorize. (You need proof they were not authorized by you.)
Charges that will not be removed from your billing statements: --You were unhappy with the poor quality of the lawyer's work. (Your remedy is to sue for legal malpractice.) --You were unhappy with the outcome of the case. (If the outcome was due to the lawyer's negligence, your remedy is to sue for legal malpractice.) --Actions taken by the court or the opposing side that have increased your legal fees. (You have no remedy for this.)
