Iris McKay

San Diego Divorce Attorney & Strategist

Strategic Planning
What is Strategic Planning?
The process of consulting with your attorney to design an effective strategy for your case.  Most good attoneys will develop a strategy with a client, but may not go the extra step of making sure the client can afford to undertake the strategy. They simply hope the client will continue to come up with the money to push the case along.

How Does This Work in a Divorce?
Iris McKay's approach is to sit down with her clients and look at herclient's goals, then focus on the family's resources, how the court system can be utilized most efficiently and mainly--how to save money and stress by keeping litigation expenses only as necessary.  Setting a successful strategy requires hard work by the client and attorney, as future issues and challenges are addressed at the onset.

Don't Most Lawyers Plan a Strategy with Their Clients?
Initially, yes.  Many lawyers will talk to the client and put together a plan that looks good at the outset.  Yet, they do not follow up to ensure that the strategy is working.  Because lawyers make money by the hour, a strategy that saves the client money may not be attractive to many lawyers.  The family court system is currently in trouble due to budget cuts and other factors.  When people are forced to use the courts to litigate, they are often at the mercy of their attorney.  Many attorneys don't tell their clients about the options of getting out of the legal system because they need the fees.

What if I Just Need Some Information Or I'm Not Sure I Want a Divorce?
Strategic planning can help you see how your life might look by giving you an estimate of what your support, custody or property settlement orders might look like.  This information can be very helpful to married people who are unsure of what to do.

How Can I Tell If My Lawyer is a Good Strategist?
As a legal consumer, you should carefully screen any lawyer who works for you.  You should have a sense that your lawyer can be trusted and has your best interests at heart, not theirs. You should also make sure your lawyer has the experience and expertise to set a strategy. This would include expertise about the issues in your case, as well as knowing the San Diego County family law community, including familiarity with your opposing counsel and your judge.

What Are The Benefits of a Good Case Strategy?
1) The client understands what it will take to get the desired outcome. 2) Client is more empowered to make key decisions.  3) Client avoids unnecessary discovery or litigation.  4) Saves money.  5) Less stressful for Client and family.
